i'm martha maccallum. this is "the story." the battle over tik tok has now kicked in to high gear. so where do you stand on this? every one tries to figure this out. senator marsha blackburn on what the senate will do now that this passed in the house. the breakdown and the chaos gripping haiti as the united states sends in the marines. we have just heard from antony blinken, the secretary of state. we'll get you caught up on that as general jack keane joins us. as of today, six counts now struck by the judge in the georgia case against former president donald trump. still faces ten more charges there. the judge said there was a lack of detail that was provided by the prosecution around the dismissed charges. some calling this embarrassing for full full d.a.fani willis as we await a ruling on her future and whether or not she can stay on this case. this is totally separate from that part of the story.

we expect we may hear something shortly from the judge on that. that came because of allegations of an improper relationship that may have been funded by taxpayers with special prosecutor nathan wait. let's bring in alina habba, the attorney for former president trump on the team on several of these cases. alina, welcome. good to have you here. good afternoon to you. what is your reaction to what happened today in georgia? >> i wish that all of the counts had been dropped because that's probably what should have been. at least it was a step in the right direction. it goes to the sloppiness of frankly the prosecutorses down there. we know that is the case. more importantly, this should not have been brought in general. the attorney handling this case put out a statement that says it all. at the end of the day, remember, we have a prosecutor here who is currently being questioned about her own ethical obligations, her ability to stay on this case. i'm going to defer to this judge to make the right decision.

today was a step in the right direction. >> martha: what goes your get tell you on this, alina, to reher from the case? >> i don't think it's indicative of her actions of fani. she's got her own issues that are outside of this case that clearly have permeated her decision making ability. as i have always said, as my clients have said, we know these are motivated by one thing and one thing only. that's election interference, trying to bring trump don. on the heels of last night, it's very clear that the american people are seeing it for what it is and will stand up and not take it very much. >> martha: i want your thoughts even though you're not directly involved in this. you're part of the larger legal team representing the former president. the first case that is set to go to trial is in new york city here on march 25. it deals with the hush money that was paid to stormy daniels. that's what the charge is in

this case and that it was diverted in the way that it was paid through legal fees. do you think that case is doing to get underway march 25 and how does the former president feel about this one that is likely to happen before -- right in the middle of the election season? >> that's a couple of good questions there. number 1, do i think it's going to go ahead? really it shouldn't. we have an immunity defense that is up on the supreme court. it will be made a decision. should be stayed until all of those decisions are made, number 1. we'll see what happens there. number 2, let's remember what this is, martha. stormy daniels is probably one of the oldest legendary let's get trump cases that we saw come out. her attorney, i believe, is in prison or was. probably disbarred. michael coen yet again reared his ugly head in that. here we go years and year later, they decide guess what, he's the gop nominee. let's bring up this case again.

we have mark pomeranz, who was in this case. wrote a book about how they didn't bring the case against president trump and it infuriated him and drove him to the point of quitting. this is all about politics. how does the president feel? exactly that way, this is political. there's no place for this in america. das and ags should not be visiting the white house and the administration before bringing complaints about the front-running candidate for the republican party because job can't walk and can't spell bob backwards. that's not our problem. that's their problem. the president is frustrated for the nation and ready to get back to work in november. >> martha: everybody watched the real estate evaluation case and the enormous settlement that they are asking for in that case. any update on when that money is supposed to be paid, what is the la latest? >> the latest is the same. it wasn't a settlement. it was a judgment. president trump has no business

or wouldn't settle for something he department do. so this was a judgment by a judge that was clearly -- miss james had in her pocket. the judgment was absurd. the number is ridiculous. never been seen before. we stand on the same decision that the appellate division has to step in and parse this all out. we're waiting on the appellate division. we'll see what happens. >> martha: i know they a bounced a bond in the carroll rise around $90 million. any closer to getting a bond in the real estate case? you're right, it's a judgment, not a settlement. no agreement made in that case. >> yeah, no, unfortunately i can't speak to that. that is privileged. i'm one of the attorneys on that case. like i said, the judgment is absurd. the fact that we're talking about this, martha, is absurd. i hope that the appellate division will to the right thing here action we have seen them do

>> martha: just now, the white house saying that it is glad that a bill banning tik tok in the united states is moving forward after house lawmakers overwhelmedly passed this legislation earlier today. the app is used by 170 million americans and it is owned by chinese company byte dance. raising red flags about our national security and data. tik tok encouraging users to fight back. gop congressman mike gallagher says that the effort by tik tok

and byte dance to push back on members of congress on the hill on all of this had some shocking results. watch this. >> without some more transparency around that, you can never mitigate against the threat of propaganda on the platform. for those that don't think that threat doesn't exist, i point to last week. tik tok asked users for zip code information. we had people threatening suicide. >> unbelievable. if this is passes the senate, president biden says he will sign the ban despite the fact that the white house has also been under pressure to keep tik tok going and boy, the tik tok folks must have been happy when they saw this on super bowl sunday from the president. >> chiefs or niners? >> two great becomes. if i said i was for the eagles,

i'd be sitting alone. >> game or halftime show? >> game. >> which kelce brother? >> momma kelce. >> martha: we didn't get an interview but we got a tik tok. let's bring in marsha blackburn. she's worked on this for years in the senate. what is your reaction today and what do you think will happen in the senate and when? >> yes, martha. i am so pleased that the house moved their legislation forward 352 aye votes. that's a very good sign. it shows that tik tok has overstepped people realize with all of these people calling offices last week saying don't do this, i'll do something to myself, people saw first hand how the chinese communist party can use tik tok and weaponize it. so it helped prove the point.

it has pushed it across the finish line. now it will come to the senate and whether it's the house bill or a companion senate bill, the good thing is this: people realize this is spyware. it is soft propaganda. it is coming from tik tok and byte dance, which is owned in part by the chinese communist party. china has a national security law. we saw this with hong kong. we know it with tik tok. they have the access to every bit of dat generates. so the chinese communist party wants to own the virtual you of 170 million american users. people are waking up to that threat. >> martha: senator, here's the political problem. 170 million americans use this and here's the former president,

donald trump, talking about this. he said he would sign a ban on tik tok back in 2020. but here's what he says now. >> there's a lot of people on tik tok that love it. there's a lot of young kids on tik tok that will go crazy without it. you know a lot of good and there's a lot of bad with tik tok. but the thing i don't like is that without tik tok, you can make facebook bigger days? >> and of course, we need to deal with facebook, instagram, youtube and the all of the others. but right now, this is our opening to stand up to the chinese communist party and say you are not going to be able to control what our young people see and say and think. we're not going to give you the ability to build a virtue you of them and to track everywhere they go. once they are in your phones. >> martha: i'm sorry to interrupt.

let me ask you about the free speech argument. there's an iron any here, it would appear. you don't have a lot of freedom of speech when your data is getting downloaded by the chinese government. what do you make of that argument? can this be spun off and be an american company that people can feel confident in and then they can keep it? >> and that is right. because if tik tok -- see, the ball is in tik tok's court. if they want to be a part of the american marketplace, separate themselves from byte dance. go through the divestiture. and algorithmically reform themselves so that they are not collecting that data and sending it to beijing, china, to the chinese communist party. >> martha: well, i think everybody would have to get new phones and get a new app in order to make that kind of

>> martha: chaos and violence sweeping haiti. an estimated 3,500 prisoners were released in to the streets. now today an elite u.s. marine unit is on the ground there to protect the united states embassy in port-au-prince. officials prepare for the possibility of a flood of haitian migrants now who would likely look to america. >> we're doing a number of things to ensure that we're keeping track of the situation and we're prepared. at the moment, we have not seen

large numbers. what we could characterize as a american mass time migration. we're alert to the possibility. i think you're right. the driving conditions in haiti could very well press more people. >> so in moments, four star general jack keane joins us. first to steve harrigan. steve? welcome. >> martha, we're getting different responses from both sides of the aisle today when it comes to the growing chaos and violence in haiti. a short time ago, florida governor ron desantis said he was deploying the national guard in preparation for potential mass influx of haitians towards florida. secretary of state blinken said the u.s. goal for haiti is free and fair democratic elections. here's secretary blinken. >> we need to see a transition to elections a clear return to a democratic path.

we need assistance, humanitarian assistance, development assistance so the economy can get built up. >> on the streets of port-au-prince in haiti, they're a long way from elections. 80% of the city is now controlled by violent criminal gangs. the acting prime minister couldn't even get back inside the country because those gangs attacked the airport. they also attacked prisons releasing several thousand prisoners. corey mills a congressman from florida, led his own mission to haiti a helicopter mission to rescue ten missionaries that were stranded there. he says the biden administration has not been hellful. >> the federal government doesn't care about the american people. i don't subscribe to that. >> the u.s. plans to spend $300 million on a kenyan peace keeping force to try to bring

order in to haiti. the kenyans won't go until they know there's a government in place. for now, the u.s. embassy remains opened on a limited basis and just reinforced with more u.s. marines. back to you. >> martha: a million children are on the streets. likely to be snapped up by gangs and enlisted in to their violent actions. thanks, steve. steve harrigan. with that we bring in general jack keane, a fox news contributor. thanks. i want your thoughts on what's happening and unfolding in haiti. the united states marines will be on the ground protecting our embassy at lease to that extent. i also want to ask you before you dig into that, sir, if you could respond to this editorial board piece from the "wall street journal." biden shrinks the u.s. military. mr. biden thinks this is an acceptable moment to put american defenses on a diet and the administration says it's

merely complying with budget caps negotiated last year with congress. few priorities escaped the acts. your thoughts as we face another protection effort in haiti at this hour. >> yeah, i mean the intel community just a couple days ago all who work for president biden's administration, actually said that the challenges we're facing in terms of global security challenges worldwide dealing with russian, china, iran and north korea. the return of trans national extremism again and the rise of a threat in afghanistan, this is the most significant challenge that we have faced in decades to include the fact that we have people crossing our border unimpeeded. yet no mention of this at the state of the union. here we have for the fourth time in the biden administration a reduction in the defense budget because there's a 1% increase,

but obviously inflation is greater than that. this is reckless in my judgment and also irresponsible. we have major threats that we're facing on a scale we haven't seen since world war ii. the willingness of our adversaries to work together is obvious to anybody that looks at this. and it means the possibility that we could have conflict not just in one region, but in two regions because they're working together. our adversaries see this when they look at us, martha. they believe the united states is weak in its leadership. they think there's political dysfunctionality here. you can make a case for it. lack of social cohesion and a military that is not as good as it used to be and has never truly recovered from a 9-11 war, which we need resources to get our way out of it. it's a serious situation and the administration is not talking

about it. >> martha: one quick point on haiti, this is representative corey mills who han his own rescue mission. he got a lot of people out of haiti. here's what he said about it. watch. >> this is a pattern of abandonment by the biden administration that has existed since 2021 when he left americans behind in afghanistan. if the government is not willing to do its job, america has to step up and do certain things that are required. if americans are abroad and they're in trouble, i'm going to come to their aid. if biden is not willing to do his job, i'll do it for him. >> martha: your reaction to that, sir. >> first of all, we should be getting our people out there that want to get out of there. and have made that kind of contact with the embassy. you look at haiti, this is a failed state. there's no government. there's no police enforcement. gangs and anarchy are ruling the day. we have learned a lesson here. we learned it in iraq and

the shells to fight back. russia firing up to 20,000 shell as day. ukrainians cannot keep up with this. putin talking very strongly today because he feels very strong. he feels it's going in his favor. >> martha: he said also the other day, why should we negotiate because they're low on ammunition? if anything, this is a moment to strengthen and move in. we heard from president biden the other night in the state of the union. he says i will not bow down. has he put action behind those words? >> president biden has been trying to get more weapons and more money to ukraine. it's held up in congress. yesterday, $300 million of weapons were being sent over. it's not enough. one of the problems is not explaining what is happening in ukraine and why russia is innovating but way that impacts the u.s. and the west and the longer term implications of not

responding. there's a reason to stop russia. there's a message that has to be sent to other dictators, a clear message that if you carry out something like this, we will respond. peer happens china looking at taiwan thinking, i'm not seeing a huge respoons from america. maybe this is my chance to do it. >> martha: with regard to the progress, there's been talk of a spring offensive. there's been some battleground gains for russia in the past few weeks. here's a map of ukrainian control in the gold color here. the red is russia control and, you know, areas that are being fought over right now. russia maintains that they have 18 to 20% of ukraine in territory. that's slightly more than they've had over the course of this. what is your assessment of how they're doing? >> you look at that map. one thing expert as agree on, russia is not losing that territory. the danger is that they take

more territory. 18 months ago, vladimir putin was willing to have peace talks because they were on the defensive. that has turned and i think russia at the moment thinks it won't get any peace talks in they are in a better position. we'll continue to see the offensive from vladimir putin and vladimir putin and the russias have adapted their own electronic war far. the drones are not so effective. half are being shot out of the sky. they have adapted and placing wings on the bombs. a lot of military techniques that are coming good again. russia is in a powerful position? >> martha: and they are in an endless position to get people? >> there's a limit to that yoon will run out of soldier before russia there. the size of population. that's not a concern for russia. >> martha: a big battle on capitol hill. $300 million has been converted from unused army funds now going

current president of the united states is on the road. he is hitting as many of these swing states as he can. we're told over the course of the month of march today brings him to wisconsin, obviously a very volatile, close battleground state and he's there today as he tries to move his campaign forward. as of last night, joe biden is the democrat nominee and the former president, donald trump, is the republican nominee as expected. we'll keep on top of that story for you. meantime, former u.k. prime minister liz truss today praising england's national health service for declaring a ban on puberty blockers for children under the age of 18. urging her government to go a step further. >> i'm delighted the health services that say no under 18s can be prescribes these drugs.

jut line in your book. what do you think as you look at what the united kingdom has now decided? >> well, look, i know from experience that there is a real struggle if you question your gender identity. we've seen a staggering number of people identifying answer transgender. adults can make decisions but children cannot. what is happening in the u.k., liz truss, has welcomed this new ban on puberty blockers but also introducing a bill to parliament to try to also define sex as biological, which would mean that any child under 18 if they're a boy they should not be called and girl and men shouldn't have access to women spaces. it's hard for lgbtq people, but we have to have some common sense here and realize that pushing hormones and puberty
