role in farming, ironically, operation crossfire hurricane and perpetuating the russian hoax. and the hoax that john durham said that never should have existed. let me put it simply. the guy that was out there accusing president trump of colluding with russia, he was the one that was actually colluding with russia. don't worry. he will be the next hero guess on fake news cnn. mcgonagle was not alone. we begin tonight with this. a simple truth and the sad reality. the united states of america today does not have equal justice under the law. it does not have equal application of our laws. we have a dual justice system. we do have a doj that has been politicized and weaponize in ways this country has never seen before. some examples. let's look at hillary clinton and her 2016 campaign paying an x foreign spy, christopher steele, a ton of money to put together campaign up research.

that was filled with russian disinformation against candidate donald j. trump. that op research known as the hillary clinton dirty russian dossier. that was farmed out to every media outlet, government institution in america as, quote, real intelligence, all in a phony effort to first shape the 2020 election results. and then afterwards when they lost, then to use those to question the results after donald trump won. in america today if you are a prominent democrat, last name clinton or biden, it is totally okay to deny election results. you can even use russian disinformation to do it no problem at all. if your last name is trump or if you are republican or conservative you will be indicted for jaywalking likely facing 10 years in jail. late last night more charges for donald trump. an 18 quote co-conspirators out of atlanta for challenging the

results of the 2020 election. with these additional 13 charges, donald trump faces a whopping 712 years, six months in prison. more than the most convicted killers on the streets that we don't even arrest or if we do arrest them we let them back out in minutes. anyway, it's not enough to beat donald trump politically. not in today's america. not in joe biden's america or doj. today's democrats in the weaponize justice system now one bidens chief political rival to be dead and die in prison for challenging an election or having views they don't agree with. right on cue and lacking any and all self-awareness and you really can't make this up, one of america's most prominent 2016 election deniers, the person that bought and paid for the dirty russian dossier, hillary clinton herself, heads over to very friendly territory at msdn see.

legal consequences for mishandling top secret classified material stored on her unsecured private servers that many enemy countries were able to hack into lake china. her office, her home were never rated. neither was joe biden. they had secret tops classified information everywhere. she never faced charges for obstructing justice after deleting 33,000 subpoenaed e-mails, wiping servers, hard drives cleaned with bleach bit and smashing phones and blackberries with hammers. she also never faced any consequences from the irani and one scandal. that scandal resulted in russia, one of our biggest geopolitical photos, getting 20% of our uranium critical to the enrichment of our nuclear weapons. and we don't have enough of it. hillary also never faced consequences for ben ghazi and although sketchy foreign business payments to the clinton foundation. i go back to my point. if you are a prominent democrat

you can pretty much do whatever you want and you will get away with it. another example, the family of a certain democratic senator turned vice president and raking in tens of millions of dollars in cash from corrupt countries, our top geopolitical foes as often is the case around the globe. russia, china, romania, because extend, ukraine. this family syndicate led by hunter biden at the time a drug addict, had absolutely no experience at all with these countries or in the case of ukraine and china in the energy sphere. but he's getting paid a fortune. millions and millions of dollars thanks to pop's. they had but one thing to sell, and that was the biden brand. the joe biden brand. access to a prominent senator turned vice president and now your president joe biden. they set up phone calls, had meetings, had dinners at the beautiful café milano with the big guy and reportedly got pops

to offer a policy for a price. at least one trusted source accused joe biden and his son of accepting a multimillion dollar bribe. and tonight a mountain of other evidence suggesting joe got paid in a multitude of other ways. a former biden business partner told the new york post that multiple biden family members paid for pretty much all of joe's living expenses. quote, his vacations, cell phones, money to pay taxes. this is joe bidens brothers, sisters, children and grandchildren taking care of him. they were being paid a fortune cashing in on joe biden's name and position. according to an 2018 text, he paid for dad's bills for more than a decade including credit card charges from the wells fargo account. why was hunter paying pop class bills. why were members of his family, nine members according to james comer, why were they getting all this money from all these

foreign countries? what did hunter biden and the grandchildren due to receive these massive sums of money? all the while hunter was quote, neglecting to pay taxes on millions of dollars in income. it's almost as if they were operating as one illicit organization with the big guy at the top. and then he had his friend's slow walk the investigation leading the statute of limitations run out. how great is this? this is typically what you see in a real ricoh racketeering case. president biden has not been charged with any crimes. welcome to joe biden's america. as far as we know he is not under investigation. instead former president trump and 18 others including his own lawyers. no attorney-client privilege. that has been waived. we will get rid of that and use the crime fraud exception charge with rasco tearing. they are not accused of accepting foreign bribes in exchange for policy decisions like the 1023 form says. like joe biden, they are not

accused of paying an x foreign spy to spread russian disinformation and interfere with an election like hillary clinton. instead there accused of challenging election results. something democrats have been doing since al gore tried to reverse the 2000 election in florida by finding votes with only selective recounts only in democratic districts. that's what they tried. left wing prosecutors charging donald trump, it isn't about the truth or democracy. it's about power and vengeance. and it's about blocking donald trump from ever going before the voters to even become president and give them the option of becoming president again. democrats have now bludgeoned our justice system using it as a political weapon against republicans and a political shield for their fellow democrats. it is now more obvious than ever and it is probably why hunter and his lawyers think they believe they can reinstate the sweetheart plea deal. make no mistake.

we know the answer. here we are on indictment number 4 down in georgia. this whole thing has been an absolute joke since the very beginning. fani willis ran as district attorney of fulton county not to ensure the safety of the residence of her heard county. she ran just like alvin bragg and just like letitia james did to get donald trump. it has been a clown show down there from day one. she made share, by the way, several days before the indictment came down, she had her fundraising site set up ready to receive donations. somehow miraculously this indictment hours before the grand jury even voted, sean, was published. i know it was a mistake. how did they know how they were going to vote down there? wow, really amazing to see this stuff. you can indict a ham sandwich. i don't think your husband eric or you've got $8.1 million with the chinese oil conglomerate

cefcu or $6.5 million from burisma with no experience or $3.5 million from a russian oligarch or another 100 money invested. we are dealing with tens of millions of dollars here. i don't see any interest at all and the fact that joe biden was getting paid all sorts of ways by all of the nine family members that were being paid. i don't know what the grandchildren did for those millions of dollars or what hunter did. do you? >> no, i sure don't. when donald trump was president we'd paid back the united states treasury from any trump properties where we had any foreign officials spend money. they bought a cocktail, we gave that money to the u.s. treasury. we didn't want the faintest hint of impropriety. and yet look at where we are in this country. look at the people at the top. look at the biden family. they are not afraid. they are thumbing their noses in so many ways at the american people and insulting us every

absorb all of this. the morning after the night before beyond the double standard. what are you thinking? >> i think it has been obvious. i hope the american people are picking up on what is exactly going on. i think it's hard not to at this point. i keep thinking to myself, what will i say to the american people else the courthouse for indictment number 4? his spokeswoman, the general counsel for the pack. i sit here and have literally litigated tons of case this for this man and watched how different the courts treat him and how his due process rights were frankly violated yesterday. what we saw was an indictment come out before the grand jury even had a chance to vote. that is un-american. it is improper and obvious for lack of a better word. i am hoping the american people get it at this point. i think you and i fight hard and kelly and and everybody that goes on these programs try to give a little piece of what is

occurring. it is up to you to open your eyes and see that we have a dual system of justice. it's not a joke. if we love this country and don't want to be kubo we better vote for the right person in 2024. >> you were a pollster in a previous life when we met many decades ago. and a very good one at that. there has been a phenomenon. this happens to donald trump as pole numbers go up. what happens, because i don't think he can get a fair trial in new york or d.c. and i don't think he can get a fair one in fulton county. that is my opinion. the jury full is prominently democrat. my question is, if there is a conviction, which i say the odds are in favor based on the jury pool if they don't get a change of venue, how will the american people react to that heading into a presidential election if he is the nominee? >> sean, i am in that business again and i will tell you that

part of why president trump is way ahead of many different republican people for the presidential nomination is people see him as a fighter and winner. they see him a little bit as a victim. as alina and others have pointed out correctly and cogently, there is a two-tiered system of justice. there is one for donald trump and one for everyone else. how can you have the most liberal county in georgia, d.c., new york city and all these places that voted against him where i don't think he could get a fair trial to be frank with you. i don't think people facing the cameras with glee, promising to get donald trump as part of their election pitch, as law enforcement officers, district attorneys and whatnot. i think he has got a lot of runway that will allow him to make that argument. but let me say this. i don't like to think of convictions and punishment and all that. it's a very sad moment for the country. we are in uncharted watters.

agenda and governing agenda. how can a party that trashes the independence of the supreme court, threaten supreme court justices. how can a party that not only wants to increase the number of democrats in the senate by hook or by crook by adding two more states get rid of the filibuster rule so they can impose their will? don't tell me they are standing for we the people. don't tell me that this is the party we count on to protect the vote. don't tell me that this is the party protecting documents and e-mails and texts when is the party of hillary clinton that destroyed 30,000 of them and was never charged with obstruction. don't tell me that these bombs believe in classified information when the jerk prosecutor in washington, d.c. has been leaking information related to classified information and bill clinton is still free to run the country side when he had classified information in his suck drawers. this isn't even about any of this.

this is about a political party that sees its opportunity to seize control and destroy the constitutional construct, to embrace these arc cysts in their party and push the equity agenda to control prosecutions, to control what is justice. we don't have a justice system, america. you and others say we have a two justice system. we don't. we have a no justice system. we may have a judge. that looks pretty good. we called them your honor and we bow down to them. we have a grand jury system that is supposed to protect a defendant which we know is a tool of the prosecution. and in the cities we know it is loaded with democrats. there is no voir dire or anything like that. these are prosecuted democrats. we have prosecutes, democrats and the guy they dragged back from the hague that looks like he should be tried in the hague, quite frankly. he has destroyed one individual after another.

while all attention is focused on his cases against trump, special counsel jack smith has a long history of prosecuting politicians including former virginia governor bob mcdonald who is a convicted on 11 counts of corruption following prosecution from jack smith's unit. upon review, the u.s. supreme court voted 9-0 unanimously overturning that conviction. the result prompted federal prosecutors to drop the charges and bob mcdonald joins us now. thank you, sir, for being with us. i looked at your case closely. this was four years of your life. over $135,000 in gifts over what they called an official act of setting up meetings and hosting

parties. and 10 years they wanted you in prison. we don't even put murderers in prison for 10 years, governor. explained this to people so they understand what the system is. >> as you know, thanks for having me on. the federal government has immense power, resources, money, investigators. after a couple years investigation they charge me and my wife who was a volunteer first lady with these offenses. after $28 million in legal fees, two of the best law firms in the country, we got to the u.s. supreme court. as you said it was unanimously reversed. the theory of the case was that because i set up meetings for a ceo of a virginia company who was also a donor and gave legal gifts to me and my family, and i said nice things about the corporation which i did of all virginia businesses. that was a quid pro quo crime.

at the beginning we have to go to the supreme court to win. we wrote a brief and eric holder would not meet with us. we met with other justice department people and told them why the review of the law was wrong. they stretched to the breaking point and ignored it and pulled the trigger. the supreme court amazingly had every former white house counsel from ronald reagan to barack obama file a brief saying it was wrong. 83 attorneys general of the states and ultimately prevailed. here is what justice breyer said. obviously a liberal democrat. what he said was to get this type of discretion to define the theories of the law to a federal prosecutor who was virtually uncontrollable is the biggest separation of powers that i have ever seen. that is justice breyer. and justice roberts wrote a very strong opinion. here is my take away. he is a harvard guy and

prosecuted a lot of cases well in international courts and for the u.s. but he lacks judgment. he would rather win then get it right. the problem with that is the government attorneys have a unique moral and ethical duty under the standards. they are supposed to seek truth and justice and not merely convict. i think his bad judgment was evident in my case. it is evident in the current cases with the president. i believe our friend jay argued that case before the supreme court for you. a brilliant attorney and dear friend. i will ask you this. apply your experience to what we are witnessing in the country today. >> to me the sad part is if you weaponize the criminal justice system so that you target your political opponents. i think a rational person looking at what happens when you have 83 counts now total between smith and the state counts that enforce separate cases from the

former president and leading contender and the trials are scheduled over it. of six months during the presidential campaign, during the primary season. i think one would wonder is this fair? is this just? when you undermined the people's fidelity and trust in the american criminal justice system, we have a lot bigger problems than who is president for any four year term. it undermines the institution very badly. i think in the cases he has brought, even if he can prove the facts in the indictment and that january 6 case, i don't see 12 citizens on a jury agreeing that these conspiracies for a president who did all the fine things for the country, that he is the one that would be guilty of conspiracy against his own country. >> many of you will peacefully and patriotically march to the capitol so your voice will be heard. your talking about prosecutorial discretion. it seems to be missing. do you see a case where we have

one set of standards for hillary clinton? classified documents. joe biden, classified documents. mar-a-lago rated and charges brought. do you see equal justice there, equal application? i don't. >> i think trying not to be biased and partisan, but looking at it rationally, what this stack of cases where he will be in the courtroom for most of the campaign. there is a sense that there is not fair play. that ethical standard of calling balls and strikes which judges and prosecutors have got to do as agents of the law, there is something really amiss here. the hunter biden case is a great contrast after five years of investigation. money coming from the chinese government. his father targeting a prosecutor who is investigating burisma where hunter biden is on the board. nothing but misdemeanor charges and a slap on the hand and a

there is no excuse for it. i can't understand how the press secretary and even stand in front of people every day when he hasn't come out and say anything. for him to say he cannot make the trip now because he doesn't want to get in the way. i've got news for you, mr. president. the only trucks and cars on the road in lahaina are government officials because it is that bad. you will not get in the way. you will be out there assessing the damage and making sure those people get what they need. if you are the strong president you claim to be the empathetic president you claim to be, you would be on a plane right now. actually, he would already be there. >> well said. governor? >> people don't understand that the president doesn't get in the way when he goes to a natural disaster or any kind of disaster. in the same way that presidents and governors go to the point where people are hurting and mass. it could be a tornado, flood, hurricane, wildfire. it could be an ice storm. you show up for two reasons.
