right now, our top story right here out of new york, alvin bragg is sweating even more than usual tonight. now, his pathetically weak case against former president trump has totally imploded. let's be very clear here, the case died this very week. it is very obvious, it is very clear, it's transparent, alvin bragg had every intention of indicting john all j trump this week, second day, grand jury proceedings canceled. telling reuters, it was former president donald trump that created false expectation of arrest. it was never actually going to happen according to bragg, it seems. really? after multiyear investigation, the formation of a grand jury, the da's meeting with law enforcement to create an impending arrest of a former president, and we're supposed to

believe that somehow, donald trump created the false expectation of arrest. now the "new york times," they reported, of course pulitzer prize reporting, they reported that criminal charges against trump were likely on march the 9th, when they first did it. remember maggie habberman, pulitzer prize for a story she got run on russian hoax, yeah, it looks leak it's going to happen. that story was out nine days before donald trump even mentioned it on truth social, his platform. so, i don't think it was donald trump that created the expectation, it was actually bragg, the media mob and his office, probably leaking to the "new york times" and probably others. and now it looks like bragg is having trouble delivering on his campaign promise, he promised during the campaign that he would go after one man, donald trump. one company, the trump organization.

one family, the trump family. and as most of you know by now, the da's entire case relied on the of a serial liar and convicted felon of michael cohen. the first time the grand jury actually heard the truth about cohen from somebody who's not a serial liar, who is not an ex con, but we heard from his former legal adviser right here on this show, bob costello, and he blows michael cohen's story right out of the water. take a look. >> what do you have on donald trump? and that's when he started with the same litany that he used for the rest of the two hours, i swear to god, bob, i don't have anything on donald trump. but the point is, when somebody is really thinking of committing suicide and you're offering them a legal way out of this, if he had any information about donald trump, that would have been the one time even for a serial liar mic michael cohen to fess up and say i know this

or that. because i want to save my own hide. but he didn't do that. michael cohen who as i said was pacing back and forth would suddenly stop in the middle of whatever he was talking about and turn and point his finger at us and say, i went you guys to understand, i will do whatever the f i have to do, i will never spend a day in jail. he said that at least ten to 20 times during that two hour period. it made it clear to us that michael cohen was saying, i will lie, cheat, steal, shoot someone, i will never spend a day in jail. >> sean: wow, powerful testimony, said to costello many times, i have nothing on donald trump. not only did costello destroy the credibility of the state's power witness, cohen, cohen himself completely contradicts the state's case, look at this annually uncovered document. this is from 2018. this is from michael cohen's own

lawyer to the fec. "in a private transaction in 2016 before the u.s. presidential election, mr. cohen used his own personal funds to facilitate a payment of $130,000 to ms. stephanie clifford, neither the trump organization nor the trump campaign was a party to the transaction with ms. clifford. is cohen lying under oath now or during that statement to the fec? now of course at the very center of the case is a completely legal, what's called an nda, over an alleged affair from 2007. there is zero evidence whatsoever that the trump campaign paid for this nda as a matter of fact, cohen says they did not. no evidence they played a role in the nda. in fact, there is no evidence that the affair in question ever took place. people can believe what they want, there is no evidence of it. according to the washington post of all places,

stormy daniels denied the affair multiple times including in writing on january 30th, 2018. this is a letter obtained by tmz. take a look at your screen., "i am not denying this affair i was was paid hush money. it never happened" even stormy daniels' former lawyer, breaking tonight, mike avanatti, tweeting in prison. i can't figure that one out. but he tweeted out that many critical pieces of evidence have yet to see the light of day, will be very damaging to the prosecution. so, let me get this straight. the da in manhattan alvin bragg dedicated thousands of hours, millions of tax dollars to a case surrounding a legal nda over an alleged affair from 2007, that both parties deny, based on

allegations from a serial liar, convicted felon michael cohen who is hell bent on getting revenge against his former boss. a low level felony, so weak, so convoluted, that a grand jury in deep blue new york city might very well and seems to be rejecting it. now keep in mind, you can data ham sandwich in a grand jury, you don't need a unanimous verdict and only the prosecution gets to present evidence. in other words, the defense gets zero opportunity to even speak to the grand jury let alone present any evidence that they have. and it appears that bragg has failed to pass that very very very low bar in this case it seems he can't data ham sandwich. sorry, can't resist. this is humiliating for the da's office and infuriating for the

politically, right, left, i had had he will, awoke, asleep, you should not want the weaponization of our justice system which is occurring here. instead of focusing on prosecuting actual criminals in new york city, a city under siege with violent crime, they are using that to harass a political opponent, that is something troubling to anyone, whatever side of the fence you sit on. it's really really disturbing of the and i'm hearing there is chaos inside that office right now. i heard from people inside the office i have relationships with who are unhappy, there is such -- disagreement on how this office is being perceived, a political actual instead of justice. you know, this is united states of america, sean. in nazi germany, in soviet union russia. in china, you pick the person and then you find the crime. you pick the person --

going to meet on logistics of arraignment. based on that donald trump tweeted, they are going to arrest me on tuesday. based on these false leaks or these real leaks that turned out maybe not to be true. but fact of the matter is, based on everything that was leaked, why wouldn't he think he was going to be arrested. try to get near that courthouse. it's as if he's there already. why wouldn't anyone think that was the plan to go forward? look, they shouldn't go forward, they don't have a case that is winnable or sustainable. not only was there not a crime committed, but there wasn't a wrong act. nondisclosure agreement in a civil settlement that happened 16 years ago. some way somehow they try to fit that square peg into a round hole. there is no campaign law violation whatsoever. and those campaign laws are very clear, they have to be exclusively for the

campaign, any ex pepped tour. this was personal funds. and it would have been used and paid irrespective of the campaign. so, that's the all end, be all, absolutely nothing else matters. >> sean: michael cohen's attorneys' letter i think is ex pull pat story and devastating. number one. bob costello right here on this program saying i have nothing on trump. and then saying over and over and over again, that not going to jail under any circumstances and the interpretation of bob costello is devastating as well. now we add according to tmz they printed the letter with stormy's signature saying that an affair did not happen. now, if it had happened and that was not a signature i would have imagined years ago they would have sued them. >> you know, and all that just noise, it still doesn't -- look,

the president's adamant that affair never happened. no matter what, it was not paid with campaign funds, michael cohen took out a personal loan because he wanted to ingratiate himself, to become part of his inner circle when he became president of the united states. if you go back a few years ago and look at the clips of michael cohen on tv, donald trump was the greatest thing that ever happened to this country. now of course he is singing a different tune because he is trying to sell a book and on a revenge tour. that is the name of his book. he is someone who is a pathological liar. according to this letter he now has a forum he lied to, fec, the federal election committee. so, he is in the least credible human being in the world. to build a case, not a former prosecutor, you would never take someone like that and build a case. add a matter of fact, alvin bragg said i can't envision a world i would bring a case on the word

of michael cohen against donald trump. somebody did something to this guy for him to do something that is politically suicidal. this will leave a stain on that office that will exist in our lifetime. i really am hopeful someone has talked some sense into him. this will be a case they will never win. >> sean: thank you. joe. tonight. other democrats they are voicing deep concern about protest that could take place if donald trump ever got indicted. now of course, they didn't have a problem with the 574 riots in the summer of 2020, some right here in new york city. in fact, they pretended that those violent riots were actually peaceful, fiery but peaceful. now, dozens of americans were killed. thousands of police officers assaulted, bricks, rocks, bottles, molotov cocktails and worse, entire city blocks burned to the ground resulting in billions in

property damage. kamala harris, other elected democrats, media mob people actually promoting a bail fund in the case of kamala harris, to get violent rioters and arsonists out of jail. npr published, in defense of looting, aoc praised the riots, tweeting, the whole point of protesting is to make people uncomfortable. congressman bush, congresswoman bush, excuse me, praised antifa, nancy pelosi said about the rioters, they are going to do what they are going to do. maxine waters, get more confrontational, get in their face. on tv the hysteria was worse, take a look. >> people do what they do. >> it's a protest, it is not -- it is not generally speaking unriley. >> there needs to be unrest in the streets for as long as there is unrest in our lives. there is plenty to go around. >> they are not going to stop.

stopped. here you have, here in new york city, this manhattan da who literally campaigned ongoing after one american. you have an attorney general in this state, campaigned going after one american. i know nothing about the allegations. i'm not here to defend them. i know president trump can defend himself. american people are tired of politics playing a role injustice and i think at thes of millions of americans look at what is happening in the manhattan da's office and says enough is enough, we have to end this political prosecution of the president and end the politics that's playing a role in our justice system around the country. >> sean: jim jordan is investigating whether or not the fbi's politicized and the doj's weaponized. i wonder, i do not believe at this point in history that we have equal justice under the law or equal application of

disgrace and i have said so. this is bigger than just this instance that i honestly believe where whether it's fbi going after a pro life father, a memorandum that targets people going to school board meetings to stand up for their kid's interest in schools. we have to make sure, very to make sure we've taken the politics out of our justice system at every level. and let me also say, the american people are tired of a two tiered system of justice, they are tired of the drama. just -- and local prosecutors ought to be focused on putting bad guys in jail in this city. and but the flip side of it is, as i travel all over the country, sean, i have to tell you, this is not the stuff the american people are talking

further aggression, we see president xi, putin, hugging and kissing each other, they are now in love. it seemed like a romance is now brewing. it's a danger to the world, isn't it? >> oh, absolutely. and that's why you see governors taking action. that's why i brought an executive order months ago to ban state contracts and telecommunication contacts within the state, we got that codified into law, signed it yesterday that now no evil foreign government will be able to gain revenue from business with the state of south dakota. hope other states will follow that as well. i brought legislation to keep china from buying our land here. i'm hopeful we'll continue to see progress on that. the reason we feel we have to be so aggressive, our federal government and president are failing. they are in dang i remembering the american people, they are weak. governors have the responsibility, a duty to protect our people. you see us getting so engaged on foreign policy issues.
