this. the grand jury, the defense doesn't get a say in a grand jury proceeding. nothing. they have zero opportunity to present their side at all. that's where you get the saying you could indict a ham sandwich. this is a weak case. maybe the weakest. ever brought before a grand jury. this is alvin bragg campaigning on a promise to go after one man, trump, one company, the trump company, and one family. the trump family. watch. >> a lot of people are wondering whatever has this job, are they going to convict donald trump? look, that is the number 1 issue. i am the candidate in the race who has experience with donald trump. i was the chief department in attorney general's office. we sued the trump administration

d.a.'s office in the years before bragg got into office? the case depends on testimony from a convicted felon. a tax cheat and admitted liar by the name of michael cohen. he is the d.a.'s star witness. here is michael cohen's former legal advisor bob last night on this show. >> during that first 2 hour meeting michael cohen who was pacing back and forth would suddenly stop in the middle of what he was talking about and turn and point his finger at us and say i want you guys to understand i will do whatever the f i have to do. i will never spend a day in jail. he said that at least 10 to 20 times during that 2 hour period. it was a bizarre mantra. it made it clear to us that michael cohen was saying i will lie, cheat, steal, shoot someone. i will never spend a day in

jail. he spent more than a day in jail. who does he blame? not himself even though count 1 through 7 related to times before he met donald trump. he blames donald trump. >> sean: will you believe the liar or that gentleman who is not a felon? according to just news.com and john solomon a memo from 2019 reveals cohen told his attorneys he has no information against donald trump. but cohen is telling a different story. do you trust michael cohen then or now? he admitted he lied in a court of law and pled guilty. that is what the bragg jury will have to answer. it's baffling right now when you consider that alvin bragg is famous for handing out plea deals like candy including

reduced charges for rapists and robbers. he reduced 52% of every felony case to a misdemeanor including many that were caught on tape on camera. in other words, a slam dunk conviction. if trump is charged it would be the first and only case that bragg ramped up from misdemeanor to a felony that we know of. this seems risky for mr. bragg given he only gets a conviction in about half of the felony cases he tries. 49% of the time he charges somebody and has a trial, he loses 49% of the time. one of the lowest convictions rates in the entire u.s. and 17 points lower than the last d.a. bragg must like to lose. and campaign finance violations are typically charged at the

federal level. the doj declined to bring any charges against trump. in 2018 a lawyer representing michael cohen issued this letter: mr. cohen used his own personal funds to facilitate the payment to stephanie clifford. near the trump organization nor the trump campaign was a party to this transaction. now bragg is trying to prove the opposite despite this clear evidence. why is bragg dedicating all of these resources. million dollars in taxes to this legal case? i can't answer that. in america justice is supposed to be blind. in america prosecutors are supposed to investigate crimes and not people. show me the man, i will show you the crime. that was the unofficial motto of

>> it's michael cohen relaying to another federal authority for which it is a felony to lie to. he committed another felony for which he was not prosecuted for or he will have to say this was truthful. if it's truthful what it says is donald trump knew nothing about the deal he struck with stormy daniels. >> sean: what did you think of the comments of bob costello on this show last night that the d.a. can't use michael cohen as a witness because he would be contradicted by costello? >> and a big firm one of the best in this country. this corroborates bob. he is a reputable lawyer without an ax to grind.

a random person and paid them $50,000 because i thought that would help trump get elected, that would be a campaign expenditure because that was my bizarre belief. it's an objective standard. that is made clear by part of the law that points out what things you can't spend money on. for example, a candidate can't spend money on a country club membership out of campaign funds. candidates can't spend money on clothing even if the candidate says i have to do a debate and i will buy a $6,000 suit. most of us would agree with this. most of us would not think it's a campaign expenditure to settle legal claims against you for

events that occurred 10 years before you talked about running for office. to pay hush money to stormy daniels or anybody else. it's a common sense matter that most americans don't think that's a campaign expense. the odd theory of d.a. bragg not only could those expenses be paid with campaign funds, they would have to be. when you look at the statute, it's not correct to say these funds count as a campaign expenditure. mr. trump paid for them with campaign funds, people in the d.a.'s office would be think about indicting him for illegally uses campaign funds for personal use. i think the correct answer there is no violation here. >> sean: the most comprehensive thoughtful answer from the fec i have ever heard.

testimony from 2 anti-trump manhattan prosecutors who embarrassed d.a. alvin bragg and resigned last year. because bragg was taking too long to bring charges against donald trump. here with more house judiciary chairman jim jordan is with us. how are you? >> [inaudible]. >> sean: your reaction to what happened today? you heard from joe. what is your reaction to their analysis of this case? >> well, i think alvin bragg may be going back to what he thought when he first won the job, he should not bring this case. the overall picture. the question is: what changed? we know the department of justice was not going to bring the case. the previous district attorney was not going to bring the case. now bragg gets elected as

do just that. is that justice? >> no, it's not. it's selective prosecution. it's wrong. the people of this great country understand it's wrong. that's not how our constitution is supposed to work. it's not supposed to attack people who are exercising their free speech rights. this whole thing we have witnessed this attack on the first amendment going after president trump, it's all wrong. that's why the judiciary committee is focussed on making sure we get the facts on the table to propose legislation to remedy the situation and use the power of the purse to limit funds going to some of these agencies that are doing this kind of thing. >> sean: how many fbi whistleblowers will you bring in? >> we have 3 testify already. we will talk to more.

if it's real, go for it. but everybody that i spoke to said no, there is more crime in this city. the focus needs to be that bragg should pay attention to the rising crime. last year 23% increase in crime in new york city. they are trying to go after president trump on an alleged misdemeanor when it's bragg who has taken misdemeanor and -- taken felonies and reduced them by 52% to misdemeanor. >> sean: this is the only case going from a misdemeanor to a felony. >> exactly. and new yorkers see right through it. this is a great city. i know there are a lot of democrats here. >> sean: not actually here. they are out there. >> [cheers and applause].

several days salivating over an imminent trump indictment was crest fallen when they found out the grand jury proceedings came to a halt. a couple of things are happening here. you put your finger on one of them. that is there is a revolt in the district attorney's office in the ranks. top senior experienced prosecutors are angry about this. they see it for what it is. a politically motivated witch hunt. a legal theory with no merit. bragg twisted the evidence because he hates donald trump. the other thing is the grand jury itself. i think all of a sudden the grand jury are saying to themselves, wait a minute, are

biden wrecked it. am i wrong? >> biden printed a lot of money. you expect inflation and we got it big time. the fed is raising rates like they have not done in 40 years. stuff starts to break. core inflation is really high including food. people go to the store to buy eggs and chicken and it's up 50%. the fed has to chase this. they keep racing rates until something stops. there is so much money -- when you print 4-trillion dollars it's hard to spend it all. we are driving up rates. it's hard to know what will happen next. >> sean: summers said to end inflation we need 10% unemployment. do you agree with that? >> there is no way we are getting there.

not this time. they made the announcement, the market went up. midway through the press conference he was hawkish and the market cratered 500 points. he is not worried about the banking crisis. he is after inflation. that means more rate hikes. >> sean: i would live paycheck to paycheck. i know how people feel. it's not a great feeling. how do you advise the average great american, the people that get up every day and work hard and pay their taxes and obey laws and raise their kids that are struggling now? you said once on the air, only 2 choices. cut your spending or bring in more income. somebody said "hannity" to poor people get another job.
