that you just saw there. that's pretty cool. thanks for biting and us into your home tonight "the story" hosted by martha maccallum starts right now. >> martha: good evening to you. breaking tonight, what exactly did chairman adam schiff and his staff become involved in the whistle-blower complaint? it's a very significant question in understanding this whole picture. we learned today in "the new york times" report that the whistle-blower had a colleague first conveying his concerns to the cia's top lawyer but then had information about how that card avenue was unfolding before him or her. then puts the complaint to work with adam schiff. schiff's office says they did not receive the actual complaint, just the quote outline, they advised that the

whistle-blower to get a lawyer and should go to the inspector general. but watch what adam schiff says about this when asked directly back on the day this whole story started to unfold on september 17th. >> martha: >> we have not spokey with the whistle-blower. we would like to. >> martha: the president had a lot to say about that in a news conference today and went a step further. >> i think it's a scandal that he knew -- i'd go a step further, i'd think he probably helped write it. he knew long before and he helped write it too. it's a scam. it's a scam. >> martha: in a heated news conference, he said none of this at this point surprises him. >> this is a hoax. this is the greatest hoax, a continuation of what's been playing out the last -- since my election, i would say. we will find out soon, but probably even before my election. >> martha: "before my

election." that's part of the equation here and moments ago seconds hogan gidley joins us, but "the story" begins with republican congressman devon did use, ranking member of the house judiciary committee. thank you for being here, congressman. your reaction. perhaps nobody was more disappointed than adam schiff in the outcome of the mueller investigation. he had evidence there was collusion and that turned out to not be the case. what do you make of the story tonight that there was some interaction between this whistle-blower and his office? >> i would say, first, i was not surprised, martha. let's get some facts on the table because i know you and your audience can be like facts. we learned about this three weeks ago on a late friday night press release that was multiple pages long, about a paragraph long. we got that, republicans receive

that, what on earth is going on here. all of you in the press office, why is this being pumped up as big? a few days later after a briefing, schiff briefs us a little bit on this and claims he doesn't know exactly what this is, but it must be really important. those are just two sets of facts that clearly he's trying to pump up and promote this story. and that we find out that, yeah, because his staff knew about it ahead of time. the thing not clear is when did they actually find out about it. we still don't have a date, when did the whistle-blower start talking to the democrats of the intelligence committee? it would've been very easy to just tell us. he had multiple opportunities to tell. >> martha: this environment, it's obvious everything is going to come out. obviously it would've been easier to say, yeah, they

contacted us, taught us exactly what to do. that's what they are saying now because he's asked that several times what does he know? how many times is that turned out not to be the case here. i want to ask a little bit -- >> i think things were leaking, martha, because we began to get rumors -- if you look at schiff's tweets, this was an easy way to get this out and probably popped up to it. what you have to remember is the whistle-blower supposedly going to come talk to us. we already got questions for the whistle-blower and one through ten, when did you talk to them? whistle-blower better be careful to make sure he tells us the truth. >> martha: do you think that person is a spy, what do you think? what's your take? >> i would say this. from reading the complaint, this

person is a supposing intelligence officer. intelligence officers are trained to not have only first-hand sources, but multiple first-hand sources that can corroborate the evidence. so this intelligence person knows this. that's not what is in the complaint. it's all hearsay. there's no first-hand evidence. to me, this is somebody -- i don't even believe this whistle-blower wrote this complaint because it's written in a way that reads exactly like the steele dossier, which, for your viewers, i think they know, the steele was a clinton bought and paid for >> martha: the president says today adam schiff had a hand in writing that actual complaint. but is there any evidence to back that up? >> no, but it looks like from at least the stories that were written earlier about this,

okay, that are from known russia hoax writers, journalists, then retweeted out by democrats on the committee, that we learn the democrats on the committee knew about it, so it has all the markings of the russia hoax. certainly, don't forget, the whole explanation how the regulations got changed a week before the whistle-blower came in and actually didn't get changed online until they were asked by the press, i think the ic ig -- i suspect that he had to know something too. >> martha: the federalists did save the rule did change on tha that. something that was already in place, they are ready made clear. we will see where that whole thing goes. congressmen do this, thank you. joining me know as was horribly. principal deputy

good to have you here this evening. i want to start with this. this is the president today in the oval office talking about this whistle-blower. watch this. >> in other words, he and other got it totally wrong or ended up the person giving consideration to the whistle-blower was just on this and this country has defined over that person was because that person is a spy in my opinion. >> martha: just to clarify here, the whistle-blower is not the person who was in the -- the whistle-blower essentially says that people tipped him off to this phone conversation. people who work in the white house. is that your understanding and do you believe that perhaps the person -- they suggested that there is more than one person, is still working in the white house? >> we don't know and i think that's part of the issue and that's part of what the president was talking about there and i think we deserve to know what's going on in the building. the american people do as well. i have to say, this whole

process has been completely ridiculous and propped up by a complacent and compliant mainstream media to the democrat party without facts. listen, adam schiff lied about having "stone cold evidence" about russia collusion. wasn't called to task for it. he lied when he passed his own words off as president trump's to congress and the american people in the transcript, and he lied about this whistle-blower. as you play the video on september 17th saying he didn't know anything about it. this is far past disingenuous, this is far past is honorable. this is dangerous. it's got to come to a stop. >> martha: i think those two incidents are clear marks against adam schiff in this whole equation. >> it's more than that. it's flat-out treasonous. he's the one who listened it to someone from russia who said they had pictures of donald trump.

>> martha: i do. >> we didn't follow up, but his staff to follow up. this is lie after lie after lie at the media keeps putting adam schiff on the same part with anybody else who has any shred of credibility. his current ability is god and needs to be how the task for it. >> martha: let's tip over to the other side of the equation and it's the single most important part of the koran zipped and the president part of the transcript where he specifically talks about joe biden and the one taking the ukrainians into joe biden and hunter biden and he wants the ukrainians to talk to rudy giuliani. is rudy giuliani the right person for the hunter biden investigation he wants so mud. >> i'm old enough to remember when the democrats cared about getting to what the happened at the bottom of the 2016 election.

>> martha: i'm talking about the 2020 election. what he had his son may or may not have done, the 2016 elections, specifically, joe biden in 2016, what's the link? >> this doesn't have anything to do with the 2020 election and the president was very clear about that and that wasn't in the call. what else wasn't in the call was a quid pro quo. i don't speak on behalf of rudy giuliani but i can tell you that rudy giuliani has been the president's attorney for a long time and donald trump what he was just a citizen, not elected to office yet, was the center was the a russian witch hoax scam perpetrated on him as a private citizen. >> martha: i understand all of that but you have an answered my question but the connection between what the president wants to learn about joe biden specifically from the ukrainians and his concerns about the origins of the 2016 election. i know about the server, i know

about hillary clinton, all of that stuff that people are concerned about, but the link between rudy giuliani and joe biden is what has raised this impeachment question and that's what the court was asked to address, and i think there are still questions about that. >> first of all, i reject the premise. >> martha: in what sense? >> this has nothing to do with rudy giuliani. the democrats were talking about impeachment before donald trump was thwarted office. >> martha: i'm talking about the situation. >> just isn't true. i think the american people deserve to know exactly what was going on with ukraine and with joe biden and with hunter biden and donald trump ran on rooting out corruption and if you'll remember it was president zelensky of ukraine on the call talking about training the swamp. >> martha: i agree with you. the whole corruption part of the conversation -- >> talking about nothing he knows about. >> martha: it's that one

section that's a later focus on in terms of this broader question here. let me ask you this, "the washington post" is quoting tonight that as part of a plan to pressure him to get more information on joe biden. what do you think about that? >> that's absolutely ridiculous. this is such a hoax and it's been perpetrated by the media -- >> martha: why was he told not to go to that inauguration then? >> there were several scheduling conflicts and we said somebody there. let's not forget, while rick perry went to that event on behalf of the united states, we also gave ukraine aid, which is something that i can say is more than barack obama ever thought about doing. >> martha: that's very true. >> we gave them legal aid, barack obama said the pillows and blankets. >> martha: one more thing to respond. this is vladimir putin who was asked at a panel discussion a

question about the 2020 elections. just watch this. >> is russia, as robert yearly or alleged, attempting to influence the 2020 election of the united states? >> i'll tell you in strict confidence, yes, we are deafly going to do it to make you finally laugh properly. don't tell anyone, okay. >> martha: making fun of the whole thing. any thoughts on that? >> we are the only ones who actually took wrestling russian meddling seriously. barack obama found out he was trying to battle in the election and did nothing about it. we took safeguards that have not been in place, a new government approach at the state level, local level, bringing in dhs and the fbi, running testing to make sure that everybody's vote counts and it's sacred.

>> martha: one last question on a different topic. reporting tonight in "the wall street journal," the doj is planning to collect dna from migraines who are in custody and to put that in a national criminal database. can you comment on that? is that true? >> i have not seen the report but i do know this administration doesn't want to secure our southern border in many different ways and we are looking at all types of avenues to do that. people scam our system and they have been doing it for decades and is chronicled on your show and we are looking at every avenue to prevent the horrific actions of human smugglers, child smugglers, drug cartels who use and abuse so many people to try and get into this country and we deserve the right to know who is trying to get in here. >> martha: thank you very much. good to go through some of this tonight. thank you for being here. coming up next to the brit hume on the situation with adam schiff and where he finds

regards to joe and hunter biden? >> look, biden and his son are stone cold crooked. you know it. his son walks up with a million of dollars, the kid knows nothing. you know it and so do we. >> martha: here now is brit hume, fox news senior analyst. good to see you here this evening. let's start with the adam schiff development. how big is this in your mind? >> it creates an appearance that looks weird. it looks strange. it looks suspicious. one reason it looked suspicious is because it's kind of on its face, but what enhances that is the fact that schiff had multiple opportunities to say that this has occurred. he asked him indirectly as you pointed it earlier. he skated around it, he disassembled, depending on how you looked at it, he might even have lied to. it may well be, martha, that the

procedures that the schiff people urge this whistle-blower to pursue where the proper ones. that might've been all there was to it. but if that's the case, there was nothing to stop adam schiff to come clean about this and say, look, we heard about this, i don't know specifically what was in the complaint. i was briefed about it by staff, but i thought the let it be know this occurred. that will be in the door will be way to do it he made all of these extravagant claims, you pointed it out earlier, about the russian collusion matter. they all turned out not to be true. he carries a certain weight in terms of his credibility. a certain burden. and i don't think this helps it at all and i do not think it helps the case against president trump, even if the actual procedures and actions were on the up and up. >> martha: it behooves adam schiff to make sure that he's got all of his i's dotted and

t's crossed so he's not scrutinized -- how about that question -- the president dodged it and so did hogan. it is a valid question. what exactly did you want ukrainians to do with regard to biden that had to do with the 2016 election? i don't think they have a good answer to that. that's why it was improper for the president to bring biden into a conversation that was supposedly about the 2016 investigation origins that's being looked at by the attorney general and others that's the problem. then the president launched into this harshly worded attack. he accused jeff mason of being fake news when he was asking a perfectly good question.

this was a sort of freak out -- angry though he may legibly be, is not helping his cause. it's not what people like about him. if you're going to get into an impeachment fight over congress you want as many people to like you as possible and i don't know if this helps. >> martha: as i'm listening to you, adam schiff's should have said they did come to us, we directed them. you just wonder what would be the reaction of the president, in hindsight, i wish i hadn't thought that up with him in that phone call. it wasn't relevant to the larger issue that i wanted to discuss with him. i don't think i would do it if i had to do it again. what would be the reaction? >> i don't know. the truth is, martha, the president's discourse is not always what you would call precise in the least. if you see it in the conversation, you see in the press remarks. he rambles all over the place and he raises subjects he couldn't imagine he could have

gotten to a given where the conversation was going. it happens all the time. it's improper, it's inappropriate. is it an impeachable offense? that is the underlying question and i think it's notable, martha, that pelosi stirred up this thing before she had actually seen the transcript of the call, which contrary to all this pain you are getting from the left, i don't think that is going to convince many americans that he should be impeached. >> martha: it's interesting that the president tried to appease jeff mason by that he had given him a long answer. secret. this investigation is all about that undiscovered question. so why is barr being dragged into the impeachment conversation? my next that's the headline of his story, blue blue along with marc thiessen, great to have you both with us tonigh tonight. eli, what's below that headline? >> there's been a conflation in some of the recent stories this week in terms of the president's request of the australian prime minister to work with the attorney general on this investigation. that is not the same thing as the issue with the bidens and the conversation with ukraine. ukraine, this is well known that there is a current probe by u.s.

attorney durham and attorney general barr as well as the desk of the inspector general to look at the overall investigation of the trump campaign both in 2016 and later, i think him when he's president and all the decisions that were made to, those are pretty fair game and they are very important questions that should be answered. there is no reason to say that it's improper for the president to say i'd like you to work with the attorney general on that. it's a completely different thing, having the president bring up with a foreign head of state to look into or investigate potential corruption of his likely arrival in the 2020 election. >> martha: there are people who are not big fans of the attorney general, mark, ever since his findings. he struck me as someone who stands by what he believes, regardless of who he's working for, and it continues to be his demeanor, i think, in this whole

situation. there are a lot of folks would love to see that in curry back into the origins of the 2016 investigation and this is an opportunity to do just that. >> yes to take it where it leads. the american people actually support this investigation because for two years they were told the president of the united states was a traitor, he was working on behalf of the russians, adam schiff's words that he committed crimes beyond the scope of watergate. he took those charges so they waited for mueller think about with the report. lo and behold, mueller report comes out and lo and behold it's a conspiracy theory. our government was tabbouleh hamstrung for two years, nothing getting done in washington while we spend tens of millions of our tax dollars chasing a pharisee theory. how did that happen quite make they were pulls right at the end of the speed investigation, 55% of americans said there was bias by americans from the fbi and

50% wanted to appoint a special counsel to investigate investigators. he embroiled john durham, a guy eric holder appointed to investigate the cia and said he was extraordinary and tireless investigator, a professional. so let him do his job. >> we look forward to what the outcome of this is. for people, eli, reading the stories of where bill barr went twice to italy, thought he went once, then twice, perhaps he went to london. what is he doing in these countries? >> it's a foreign administrator who had a conversation with a low level trump campaign, george papadopoulos who said he had dirt on hillary clinton which is fairly general. that apparently according to the latest version according to the fbi is the origin of the counterintelligence probe and you have to understand, while the fbi is investigating, they

never gave a briefing to anybody on the campaign like chris christie. they decided to use invested invasive techniques. these were decisions that were made based on exactly what's? part of that is business really prime minister, part of it involving a professor who is originally from malta and taught at a university in italy. of course, united kingdom where papadopoulos had these meetings with people and at times fbi undercover agents. so the question is what role, was there other intelligence set that the system, it was that intelligence given to the cia director make its way to congress, particularly a letter from harry reid wrapper for the election? those are legitimate questions. >> martha: with all of that going on that the campaign wasn't included in their concerns and maybe they ought to check it out. thank you, gentlemen, eli lake and marked and mark klassen.

>> martha: moments ago, a jury reached the decision in the case of and amber guyger, a former dallas place officer shot an unarmed man in his own apartment. she claims to mistake his apartment for her own and says she thought he was an intruder after she got home from a long shift. correspondent trace gallagher joins us now. the back story here tonight. hi, trace. >> hi, martha. amber guyger sentenced to ten years in prison. throughout the day, there was heart-wrenching testimony from those who were close to both guyger and both of john. the mother told on multiple

>> martha: terrible story tonight. we learned at least seven people died after a world war ii era plane crashed shortly after takeoff at connecticut's bradley international airport. 13 people were aboard on the b7 bomber after it reported getting problem gaining altitude. the plane was nicknamed 909 and was repaired after previously crashing at a pennsylvania air show back in 1987. an investigation is underway. and president xi jinping of china had people working around the clock to make the celebration of 70 years of communist china a huge success and a success of military might showing of hypersonic missiles that could reach the united states in 30 minutes. but it was marred by the rising house in hong kong, now in its 18th week. uncertainties surrounding the trade war around the two
