>> bill: geraldo on why six states refused to pass jessica's law. caution, you are to enter the no spin zone, the factor begins right now. captions by closed captioning services >> hi, i'm bill o'reilly. thanks for watching us tonight. pinheads in toy land that's the subject of this evening's talking points memo. we have stood up for christmas on the factor. swafting away -- swatting away attempts by secular pro-greives. gibson wrote an entire book documenting most of them. this year most retail companies are saying merry christmas. a few years ago companies ordered their employees not to say it. but in the nation's public schools, the battle over christmas sometimes still pops up. for example, a fort worth texas independent school district sent a memo to staff saying that if students are

allowed to exchange cards or gift on school property this year then the district would be required to allow students to distribute religious messages along with the gifts. what? required by whom? total b.s. fort worth school spokesman clint bond put it this way. >> we have students and parents who don't see santa claus as the icon for this time of year. so we have to be concerned about what their feelings are as well. >> so let me get this straight, if an image of santa claus is seen on school property some students might be depressed? sure. as soon as we began calling down to fort worth, the tone changed. here is mr. bond today. >> the district cannot endorse or promote or foster any particular religious belief or doctrine. so, what we are saying on our -- in our policy about seasonal celebrations is

basically use common sense. you know, any of the current icons that are out there like santa claus or christmas trees or, you know, snowflakes or any of those icons that we all use are fine for the classroom. >> bill: good. we're glad the school district will not deny its students freedom of speech and expression. and since christmas remains a federal holiday, it might be nice for all american teachers to explain to the urchins why that is. who on this earth can explain rhode island governor lincoln chafee. every year the ocean state puts up a big tree in the public square. this year some folks wanted the governor to call it a christmas tree. but to quote john belushi, no! governor chafee insists it's a holiday tree. >> lawmakers voted to call this a christmas tree. but the governor calls it a holiday tree. >> i have my own religious views but as a government official i want to keep it separate.

>> you call it a holiday tree. >> yes, i am. >> amazingly dumb. off the charts stupid. governor chafee must know that the christmas tree display began in germany in the 16th century for the specific purpose of providing celebratory decorations for december 25th. the day day of jesus' birthday honor. we asked him to appear on the factor to explain history. predictably is he hiding under his desk. here is the question. maybe the staff can relay it to the governor laying on the floor. what exactly is the rhode island tree representing, governor? arbor day? whether he knows it or not, chafee has offended far more people than any christmas tree ever could. rhode island was founded by roger williams in the name of tolerance. how about a bit of tolerance toward folks who respect christmas traditions about 90% of us? and that's the memo. now for the top story tonight, freedom of expression, did fort worth come close to

violating it? joining us from philadelphia jennifer brant an attorney interested in first amendment issues and fort lake murray florida. congressman walters what say you? >> i say students clearly have a first amendment right not only to freedom of speech but to freedom of expression of their religion. and to the extent that they are being told that they can't exchange christmas gifts or can't pass messages along to other children, that's a potential violation of their rights. and so long as it's not interfering with the classroom instruction, so long as there is no problem caused in the classroom with their teaching, they should be able to do it. >> bill: the way i read the constitution is that the state, the federal government has -- cannot impose religion on anyone. they can't. no state can say we're a catholic state, jewish state. the federal government isn't a say you have got to worship any way you want. am i correct, counselor walters at that point? no imposition of religion in the constitution.

>> what you are talking about there is the establishment clause. >> bill: that's the only place it's addressed. but if a person wants to walk into a public school, counselor brant, a student and say merry christmas, they can't stop them from saying that and if he wants to give a token of his or her interpretation to the a friend, a gift, they can't stop them. >> larry and bill, you have got this one wrong because the school isn't infringing on first amendment rights of these children. it's merely establishing some reasonable limits to allow for education of the children, because that's what they're there for. and to prevent alienation of any other children. >> bill: what is reasonable, counselor, about a school telling a child they can't say merry christmas? what is reasonable? >> that's not what they are saying. they're not saying. no, no, no. i think you are wrong. they are aren't saying you can't say merry christmas. we are not going to have holiday parties. we are not going to endorse christmas. >> bill: counselor, hold it

now they changed. >> wait a second, bill. >> bill: they changed it and you know it they changed the first memo said huh-uh huh, don't you give us any displays and now the guy comes out with a hat as soon as we call down there he has got the hat on, the santa hat. >> it was his christmas tie. >> bill: you had to have heard the sound bite, jennifer, he said you can have the icons of the season in the classroom. so they changed it, counselor walters. and i think they changed it because they know what you said is absolutely right. you can't tell a kid not to say happy hanukkah, merry christmas, happy halloween or happy anything. >> we are all in agreement as long as the school is not endorsing and say this is what you must do, you must give christmas gifts at this time then they are free to give their christmas gifts to each other. with all the bad things going on in school all these days prevent kids from being kind to each other it seems absurd. >> the school is allowing the children to exchange gifts. they are saying don't exchange

these gifts during classroom time. that's reasonable. that's not taking away christmas from anybody. >> bill: that was a reuse. >> if you want to celebrate christmas can you do so during your own time. don't have to do it during school. >> bill: your own time the student is compelled to go to school. has to go to school. >> why do you have to have christmas there? >> bill: why do you have to have it because it's a federal holiday that's why. >> it's a federal holiday. what about the children there that don't celebrate christmas how do you think they feel. >> bill: say merry christmas back or instead of merry christmas. >> you are not being inclusive here. i think you are wrong. >> this is the law of the land. >> it's not the law of the land. our country was founded on being free and not having imposition of any religious beliefs on you. >> bill: revoke the holiday. >> when you go to public school, you should have the freedom to believe what you want and not have any religion pushed down your throat. >> giving christmas gifts -- >> bill: listen to yourself,

organization, the libyan answer, you know, it was just kind of a thing that caught up with him. i think he was pretty good for the campaign. >> i think he was great. i thought the 9-9-9 plan was good. i like herman cain, he is a friend. he has had a remarkable career. i hope the memory people have of her main -- herman cain is not of the last two weeks. >> bill: now you have gingrich and romney pretty much as the frontrunners, and a lot of people make the poll last year when giuliani was the frontrunner you were third or fourth. >> fourth or fifth and fred thompson was second and john mccain was third. mitt romney was fourth and i was a distant fifth. >> bill: the difference is there have been debates. >> there had been 10 debates before at this point in time. >> bill: when you were running? >> yeah. >> bill: iowa comes up the third and then you have got christmas and new years and hanukkah in between. i think it's going to come

sexual battery on a child, you get a sentence, one sentence no, plea bargain of 25 years, that's the max, then it goes down to 10 years in places like massachusetts. and 44 states have passed it. but let's take the ones that haven't. new jersey surprises me because chris christie is a fairly conservative guy. but he is not behind this law as of yet. >> what is interesting is, i just spoke with assembly woman nancy muneuz prime mover in the garden state. i talked to nancy and she she says she has 54 co-sponsors in the assembly. there are 80 assembly people. >> bill: that's huge. >> you obviously have more than the 41 votes you need to pass. it is stuck in the appropriations committee. what's really happening, i think this is the back drop to all the states that have refused to go along with this crusade. the back drop is that the judges refuse or are reluctant to yield their discretion to impose sentences according to

what the judge believes. instead of one size fits all, which gives you certainty in sentencing, what you have in new jersey and other places are very powerful judiciary that says wait a minute, you are saying 25 years mandatory. what if i have a different defendant who is more sympathetic. >> you take it out of the judge's hands because of all the abuses that have happened in the past. >> that is why it is mandatory but that's what's happened. >> bill: is christie for jessica's law or not. >> that's an excellent question. we have been unable to get the governor to commit. >> bill: this is ridiculous. >> in iowa and new jersey, they suggest the new legislative session which starts january of 2012 that these laws might get to the -- >> bill: idaho. >> we want everybody to go to all of these governors. now, how do you get to christie? put that up on the screen. you go to christie's, what, facebook page? is that what it is? tell me what it is in my ear. his web site. all right. new jersey.gov/governor, you
