indications are that mcconnell does have the votes. senator bob kosher is the long republican holdout. the final vote is not expected until very late tonight or perhaps early tomorrow. we'll have the full report and much ado about nothing. special counsel would beer mueller charging former national security advisor michael flynn with lying to the fbi. but so far there is no evidence of collusion and we know that collusion itself is not a crime. we'll take all of that up here tonight. our top story, the justice department issuing that arrest warrant for jose garcia zarate. arrest warrant urn sealed in the western district of texas by the justice department. it accuses him of violating his supervise release, an existing

federal detainer requires that he reef naint custody of the u.s. marshal service and he will be transported to the western district of texas pursuant to that warrant. perhaps justice will be served after a san francisco jury sided with the defense and said the shooting was an accident. the juriy was not told he was a 7-time felon and five-time depore tee. and his attorney wasted no time in further politicizing the tragedy. >> for those who might criticize this verdict, there are a number of people who comments on this case in the last couple years. the attorney general of the united states, the president and the vice president of the united states. let me reminds them that

let's start with the lack of verdict out of the kate steinle case in san francisco. >> there was a death of a young woman on a pier. if you want to say the prosecution didn't prove murder, couldn't prove intentional killing beyond a reasonable doubt. what happened to involuntary manslaughter? the unintentional killing in a reckless act. you are going to tell me having an illegal firearm and discharging it on a public pier is not reckless? lou: is this something that could only happen in san francisco? >> no it could happen right here in philadelphia. we are a sanctuary city and people like our mayor don't care. you predicted we would see incidents like this and now
