>> we begin with legal battles galore in georgia with the da in his georgia case. will she get the boot in trump's georgia case? we could get that answer any moment. but an entirely different case. will donald trump be on trial this summer? the former president will soon leave mar-a-lago for a critical cool hearing inside a florida federal court this morning, the judge overseeing his classified documents case will hear arguments from trump's team to dismiss charges or delay the trial. the trial was initially scheduled for may. prosecutors now one july, but if trump wins his delay, which has been a winning strategy so far, the trial might not start until after the election. and if he wins the presidency, he could then order the doj to drop his charges. cnn's kaitlan polantz is outside the courthouse in florida. i guess, in the coming

hours, what are we expecting? to happen here just in light of this hearing that is going to be happening and the ask to throw the case out this is going to be several hours of arguments in court today before >> judge aileen cannon, criminal defendants that are going to try always get to make attempts to tell the judge this case should be totally dismissed. and that's what donald trump's lawyers are doing today. there's a series of arguments that they're going to need to make over problem we a series of hearings. but today, donald trump is not just any criminal defendant. >> and the >> argument his lawyers are going to be making is he was president. he took documents out of the white house. that's because he wanted to say they are hit and they were not the presidential records that should belong in the federal government because he had the power as the president to say they were personal records. that's the argument we're going to hear from trump's site today. but the justice

department has been very clear since the very beginning. the national archives has been clear. that is not how it works. the presidential records act, which is what's going to be talked about in court today. that says that records just can't be deemed personal by the president if he sees fit, there are certain records that are the property of the us government and in a situation like this, where their national security purity records, justice department says, it's criminally problematic for someone to take records, even if they were the president while they were still in the white house they were national security records because they could jeopardize the entire country. and those records belong to the government and the people of america. so that is what's the stake today. >> we're going to we'll be watching to see what judge aileen cannon does. there is quite a bit at stake for her. she previously is a judge who had ruled in favor of trump, giving him a lot of deference as the former president's. so we'll see where she's leaning

today. we don't expect a decision from her on this argument today and whether to dismiss ms the case. but it is quite a critical hearing where trump is expected to be important. >> all right. kaitlan polantz, i know you'll be there watching all things. thank you so much. we'll come back to you if you've got some news kate, you know what? i think there is nothing that is truer than so many cases, so little time. >> yeah, lots of things. yeah, lots of things from florida to georgia. now, where multiple things are happening, trump and his co-defendants are waiting to hear if the judge is going to keep or disqualify the fulton county district attorney from let the election subversion case there. that decision could drop any time now and trump and his co-defendants are also waking up to facing fewer charges there. the judge dismissed six charges of the 41 count indictment in the states in the state's criminal case trump is now down three charges because of this. cnn's kristen holmes tracking this for us. she joins us now, kristen, what are you

hearing about all of this >> you talk about, let's start with georgia. you talk about these six charges being dropped. obviously, yes, this is a good thing for donald trump. what you're talking to his team, they're really just waiting to see what happens with the district attorney. they are obviously happy that there are less charges, but they would like no charges at all. they would like to see fani willis pulled off the case. they would like to see a way for them to get out of that case altogether. now, when you look at the broader picture we have seen donald trump now wanting to participate in these various legal trials. one, today, go into fort pierce keep in mind there there are no cameras, there are no speaking engagements. there is no opportunity to see the former president yet he is still going. this is obviously not one of his traditional campaign stops in the courtroom. instead, we are told that he wants to participate, that he has told people he wants to be there for every single day, every single hearing up until this potential controlled trial, partly because this is kaitlan, poland's was just reporting this. that they want the judge to see him and he wants the judge to see him to

show him as a willing participant in this trial that actually extends to the trial that we know is going to happen later this month in new york. i am told that donald trump is still planning and his team for how exactly it's going to look between a general campaign election trail and going to court every single day. now, remember, in new york, this is a criminal case. he does have to be in court every day, but early on there are some procedural days that he wouldn't have to be there including jury selection. i am told that he wants to be there for every single part of this. so what this is going to look like is how campaign goes on the trail. actually campaigns in these critical swing states. and then also on the other hand, is in court every day trump himself saying, oh, go to court in the morning, i'll campaign at night. we are talking to his advisers. they acknowledge that this is likely not possible. so instead, they're looking at ways around that can they campaign on wednesdays? that's the one day in new york where they're not in court as well as saturdays basically no court on the weekends, can they send surrogates into these critical ground battleground states? this is all being figured out now, but we're really in

them. i can't imagine that was reassuring for the people on the plane, tom now this whole thing is unsettling and extremely odd. listen to what alaska airlines says about it. they say a passenger who appeared confused, attempted to access the flight deck and a non-violent manner. the passenger was non-compliant, which prompted our flight crew to enlist often read law enforcement officers to help restrain him. >> but if you look >> at the sort of the bullet points of this, it is even more confusing. essentially what happened is this guy tried to open the flight deck door three times, apparently sort of in rapid succession of hingeley, they used a beverage cart to block the cockpit. he was restricted trained in flex cuffs and these officers set on either side of him for the remainder of the flight and the issue of mental health concerns have been raised here. that's important because an attorney representing this young man, nathan jones, for the family, said they are gravely concerned about his mental health at this

point, the behavior describing the affidavit in support of the criminal complaint are inconsistent with this young man's life. we've requested he undergo a court ordered competency evaluations, so exactly how all of this unfolded at this point. it's not clear how aggressive it was, is not clear what intent was involved here but anytime anyone tries to get into a caucus, pitt for any reason, even if it turns out that they were having some kind of mental-health crisis while it's a big, big concern because that can be a big problem, doesn't matter whether or not they meant it in a malevolent way, john. >> yeah. you have no idea what's going to happen if he gets in if he gets through that cockpit door. >> well, in the times live in so many questions about things like that among passengers and crews. so i will have to learn a lot more about this as we move on. and of course, he found in his notes, in his bag all sorts of things about how to take off a plane, land a plane, and things like that. >> what does that mean? >> we don't really know all

>> good, morning, sara. it absolutely isn't. it's really been something that the vice president has been leading the charge on. in fact, she was just here last week in milwaukee talking about abortion and right. she will be in a minnesota today, as you said, and is really part of the biden harris campaign's plan to try in remind american voters that this election, in fact is not the same. yes, the same two candidates are at the top of the ticket. both joe biden and donald trump, but there are many different issues, of course, first and foremost is the supreme court overturning roe versus this is wade. and the fight for reproductive freedom is at the center of this campaign. but with the vice president and visiting this clinic in minneapolis, it raises a couple of points. one that there's no state really in this part of the country in the upper midwest that is politically secure for this campaign. they realize that they're going there to campaign as well in a political context. but conversations we're having with voters in the week after the state of the union address certainly is bringing up this point. we had a long conversation with the certified middle life here in

fulton county da leading the criminal case against trump in georgia will be disqualified from handling the case. and the presiding judge has promised his decision will come by. week's end. we know trump in several co-defendants want her removed over allegations that she benefited financially from a romantic relationship with the lead prosecutor on this case, the da says that never happened and even before that, trump is facing fewer charges in georgia. now, after the judge tossed tossed out six charges, including three against trump, let's talk about this joining us right now is cnn legal analyst and former us attorney michael moore. let's talk about dropping these charges, dropping any charges at this point, michael does what to the strength of the case against trump >> well, good morning. i'm glad to be with you this the motion that was filed by the defense's called a demurrer. and what that is simply a challenge to the legal sufficiency of the indictment. it is standard and almost every criminal case, there's nothing particularly unique about this and what it does it ask? the

court to look at their diet, but in find out a bit sufficiently puts the defendants on notice so they challenged whether or not hear the charges dealing with solicitation to get someone to commit a violation of their oath, whether or not those counts were laid out with enough specificity to move forward. the judge said they were not. >> now, it has nothing to do and this is probably the most important line. it does not dismiss the whole case. and in fact, the da has the opportunity to come back and re-indict on those charges to bring a new indictment, cleaning the cleaning up what the judge said was correct. and he also put in a footnote if the da disagrees with his decision, he would likely agree to let live appeal in the interim. so it's a speed bump, it's probably a little bit of an embarrassment to the district attorney's office, but it is not fatal to this case. so the case will move forward. the question before or not they tried to re-indict and put six cows back in or if they move forward, these six counts viewer i'm curious if you how you would advise on this

because when you hear resubmit or seek an appeal, that sounds like that >> sucks up time necessarily. obviously. so right way. what would you advise? >> well, i think that the conduct at issue is spelled out in the rico charge. that's the most significant the conspiracy count that remains in the indictment. the conduct is still there and i would just tell to move ahead. just keep going. this indictment was probably a little fat to start with. so trimming it up was not a bad i'm not a bad outcome. it takes a little bit of burden off the state. it removes some appeal issues and frankly, you could have moved forward in this case with a much more truncated type type indictment in criminal charges. so moving ahead is not going to hurt him. it's not going to change the ultimate outcome at all. just simply is these six kind of technical counts have now been removed. >> let's talk about what kind of pending decision from the

judge on whether or not fani willis, the district attorney in fulton county, will remain the lead will remain overseeing and running this case against trump and others. >> if >> fani willis gets dismissed, what happens does the does the case go to another county? and i then wonder, what is the significance of where the case would then land? >> yeah georgia has what's called a prosecution, prosecuting attorneys council. >> in that >> council that the head of that agency they would find a district attorney who would be willing to accept the case. so they would basically become special prosecutors if you will, are specially appointed da's for fulton county for this particular matter to move the case for. but remember that if that happens every decision about the case, then rest with that new prosecutor, that new district attorney that's brought in. so he or she may say, well, you know, we're moving forward just like we haven't. he or she may also say, you know, something i've

just i've looked at it and i don't think this is appropriate and i'm going to end the prosecution the case. so a lot of discretion moves forward if that happens. now, i do think it's likely that this case will not be heard this year, and i think the judge signaled that in this very recent order, he he when he talked about the ability to appeal and also think the further we get into the calendar with all these things that have been happening in the speed bumps at the state has been running into that. it's a pretty clear indication that we won't get there before the election. and i think if there's a new prosecutor pointed, there's no possible way to get to trial on the books and in the courtroom before the election all right. >> let's see we can get some answers to this. some of this even today, it's good to see you, michael. thank you. john. >> all right. happening now, we are standing by for a highly anticipated space x rocket launch this morning, the window opened shortly and the weather looks good. this will be the third test flight for the companies giant starship rocket after two previous attempt

ended in flames, they need this ship to stop blowing up as part of their mission to put humans on mars. cnn space and defense correspondent kristin fisher is with us this morning, watching and waiting for this launch, which they really need to work. chris they do and nasa is certainly watching this one too because of course, starship, absolutely critical to nasa's >> artemis program to return american astronauts to the surface of the moon. since the apollo program so john, what we're hearing right now is that the weather is about 70% favorable for launch. they're dealing with some i'm slightly higher than normal winds and some fog down in boca chica, texas, which is right on the border with mexico there. but if all goes according to plan, starship is going to lift off at about 8:30 am eastern time this morning. and then what you'll see is the super heavy booster and the starship rocket on top they should separate. that should happen at a successful hot stage separation. and then the

booster should splashdown fairly gently. in the gulf of mexico while the starship rocket on top should reach orbital speeds and then splashdown in the indian ocean. and john, that is different from what we have seen in the previous two starship flight tests. it was supposed to splash down in hawaii off the coast of hawaii. this one different in the indian ocean and that's part of the reason for this delay, john, in the faa license, they were doing an environmental assessment on the impact that starship splashdown in the indian ocean. and so spacex only got its launched license yesterday evening at about 05:00 p.m. so they've turned this around quite quickly. but so far, all systems go for launch. and john, we're looking at liftoff in just under an hour now all right >> fingers crossed, so yeah, they want this to end in different oceans. they also want this to end not in flames like the previous two. watching it very closely, kristen, thank you very much, sir.

>> all right. the white house is now urging the senate to take swift action on the bill that could end up banning tiktok nationwide. but senate leaders remain uncommitted on if and when they might do that, the house quickly passed it yesterday with huge by partisan support. the bill would force tiktok's chinese parent company, bytedance to sell it or the app would become illegal to download in the united states, this all stems from concerns turns the chinese government could use tiktok to spy on americans and spread disinformation joining me now is cnn chief law enforcement and intelligence analyst, john miller. what exactly is the government worried about when it comes to tiktok and its influence? >> no. two things. first thing is the amount of data they collect on users and where that goes. so the name, date of birth, browsing history, what videos you look at, what videos you share, what videos you post, who your contacts sa'ar, browsing history, but tiktok

has also been accused of key locking, which is following what you're putting in the keyboard, which could lead to passwords, personal messages, and so on. now, tiktok testified in congress that they only do that too. seek out robots do debugging. but you can't know for sure because it's a chinese company. the second thing is what they do it that information when the chinese government, from an intelligence standpoint, a hostile foreign power wants it. and the problem there is, they may represent that we're not a government agency. we don't share that, but there's a 2017 law in china that says, and i quote now all organizations and citizen shall support, assist, and cooperate with the national intelligence efforts. meaning, if the government asks for a flow of data, all of it, or some of it, or one individual person the answer know from a company is not an option, right? >> that law says, otherwise they have to comply or face consequences. i do want to ask you though, when it comes to

the gathering of information and misinformation, i know that's been thrown out there as well. i mean, what's the big difference between google, facebook, or what we saw them do? especially during election time, and how they collect information from american and how they share it and sell it and everything else. and the big difference is that last point which is if the us government wants that inform people in america, have this two-tiered system of suspicion. one, if their credit card, their bank, their internet providers, collecting all that information they have a much lower threshold for well, that's okay. i signed the user agreements when the government wants it, that threshold goes up y who said, what's it for? again in china, that's not an option, but i think if you look at it in the bigger picture and this is really important to consider. let's just look at tiktok in a vacuum look at the activities of the chinese government and its intelligence services in 2014, they hacked the us government's office of

personnel management they stole 4.2 million sets of data, including the records of every government employee with a security clearance from secret to top secret to hire now, that is a goldmine of information, then allegedly hacked the anthem health provider records and got 7.2 million records, which gave them a baseline of government employees, which anthem did help for the federal government that they could use to compare those records, correlate them, make sure that they had the right people when they were doing a profile imagine a us intelligence asset, a cia agent, an intelligence officer sir, arriving in china, putting down a passport and a red light goes on to the chinese intelligence service says, here's who comes in. this person has a security clearance. we have correlated in disambiguated his record. here's his entire life story, and then add into that here's his browsing history. here's his tiktok history. here's his keystrokes they're digging and

as i said, we all do know people who have suffered from this >> yeah, john, there's a lot of excitement about these findings, although they are early. and as you mentioned unfortunately, some of these results were temporary, but they do show a potential path forward for this technology. now, as you mentioned, glioblastoma is the most common and aggressive form of primary brain cancer. it affects about 12,000 people who are newly diagnosed each year in the us. and it's very difficult to treat the median survival right now is about 14 months with current treatment, which involves trying to take out the tumor if you can radiation and chemotherapy, but we need better options car t is what's known as a living drug. you're actually taking a patient's cells out of their body and then they're getting reprogrammed to express proteins on their surface that help them home in on cancer better and to better fight cancer, then you're multiplying those cells and you're giving them back to the patient. so it's actually their own souped up cells. that's trying to fight cancer. this

has been successful for a number of blood cancers, but so far so-called solid tumors, things found in the brain or the lung, or the breast. there has not been success with car t there. and so this is a very early stage study, phase one, we've actually seen three different early-stage trials just published in the last week i'm. fraser is one patient who participated in a trial at mass general and massachusetts. that study was published last night in the new england journal of medicine we've got pictures of him and his wife. we can share with you, but also really excitingly, you can see the pictures of his brain. his tumor was in his brain. he got the car t treatment than a couple well days after the treatment, they saw that tumor had shrunk by almost 20%, 60 days later it continued shrinking by 60% and continued to improve over six months. unfortunately, there were two other patients in this trial. there's came back within 1.2 months. so there's a lot more work to do who here john at to try to make sure this can last.

one of the things they were saying is that government is tied itself in knots through partisanship and gerrymandering and the rest of it. so i'm not sure that we would get a much better results. if it was owned by the government, are owned by the public in that way. but certainly what we're seeing is the complications and problems that result from single individual people having so much power, not just elon musk, but mark zuckerberg and his control of facebook amazon the way it has dominated retail and jeff bezos, we have a, you know, kara swisher has a great book out now, all the tech journalist called burn book, and she talks extensively about the problem with having single people have so much power over communications in business, in society so this thing with dawn and elon musk may feel like a tempest in a teapot, but it is emblematic of the idea that a single person can get upset and
